There is no regulation which states you need an attorney. However, you have a significantly better chance of winning your claim for Social Security disability benefits if you have an attorney representing you.

A Social Security disability attorney may NOT charge you a fee for representation unless the attorney wins your claim and obtains retroactive ( back benefits ) for you.

If you have an attorney assist you and the attorney wins retroactive benefits for you, the attorney's fee MUST be approved by the Social Security Administration. Under Social Security Administration regulation all attorneys are paid the same amount.

A Social Security disability attorney who wins retroactive benefits for a client, will be paid 25% (1/4) of the retroactive benefits.

Congress regulates the fee an attorney may receive for handling a claim for Social Security disability benefits. The attorney will NOT be paid more than $6,000. In order for an attorney to obtain $6,000, the attorney MUST obtain $24,000 (four times $6,000), for the client. From the $24,000, the Social Security Administration will pay 25% (1/4) to the attorney.

If the attorney obtains, for example, $1,000 in retroactive benefits, for the client the attorney will be paid $250. If the attorney does not obtain retroactive benefits for the client, the attorney will NOT be paid a fee for representing the client.
